RentSpree, Inc. (“RentSpree,” “we,” “us” or “our”) respects the privacy rights and concerns of all users of the website where this Privacy Policy is posted (the “Site”) and other services made available by RentSpree (collectively with the Site, the “Service”). As such, we’ve established and implemented this Privacy Policy to inform visitors to the Site and users of the Service how we use and protect the information we collect. By accessing or using the Service, you agree to our Terms of Service and consent to RentSpree’s collection, use, storage, deletion and disclosure of information relating to you as set forth in this Privacy Policy. This Privacy Policy is effective as of the date set forth above and is only applicable to the Service and not to any other websites that you may be able to access from the Service which may have their own data collection and use practices and policies. Capitalized terms used but not defined in this Privacy Policy shall have the meanings provided in our Terms of Service.
When you access the Service as an employee, owner, director, officer or contractor of a company, partnership, sole proprietorship, nonprofit or other legal entity, you represent and warrant that you will only provide information and use the Service acting in that capacity and that your communications and transactions with us (on and off the Service) occur solely within the context of RentSpree providing the Service to the company, partnership, sole proprietorship, nonprofit or other legal entity that you represent. Please note that this Privacy Policy does not govern information we process on behalf of our clients. For details about our processing of Client Data, please see the “Information from Our Clients” section below.
If you have any questions or wish to exercise your rights and choices, please contact us as set out in the “Contact Us” section below. If you are a California, Colorado, Connecticut, Nevada, Utah or Virginia resident, you may have additional rights set out in the state-specific sections in this Privacy Policy. This list of states is not exhaustive, and residents of states not included in the state-specific sections may have additional rights relating to privacy and their personal information.
1. Information We Collect
Types of Information We Collect. When you create an account, request a demonstration, contact us, submit a request to us, engage in live chat (whether with a chatbot or a person), link your account, request a rent estimate, refer someone, provide payment information, submit a rental application or otherwise provide information to us, we may collect personal information from you including:
- First and last name,
- Email address,
- Phone number,
- Mailing address,
- Account name and password,
- Any images or files you upload,
- Location information, and
- IP address.
In addition, if you are a landlord, property manager or property owner, we may also collect:
- Company name and address,
- Your title, business email address and phone number, and
- Details (including rental price) regarding a property and particular listing.
In addition, if you are a prospective renter, we may also collect:
- Credit score and overall creditworthiness,
- Criminal history,
- Eviction history,
- Billing address,
- Postal address,
- Other occupants/applicants including their names and email addresses,
- Payment information,
- Date of birth,
- Employment history (e.g., current and prior employer, salary, supervisor name and contact information),
- Salary/income history,
- Emergency contact information,
- Agent information,
- Residence history (e.g., current and prior addresses, rent amounts, landlord names and contact information, move-in and move-out dates),
- Reference(s)’ contact information,
- Pet information,
- Your application status (e.g., if your application has been accepted, denied or is in progress),
- Driver’s license and/or identification card images and information, and
- Images or files uploaded to your account.
If you apply for a job at RentSpree through the Site or otherwise, we may collect either directly or through third-party employment or recruitment sites or recruiters and employment agencies:
- Your name, address, email address, birthdate, gender, Social Security number, driver’s license number,
- Employment and education history, and
- Other information you provide in your application or resume and throughout the hiring process.
We may also collect information when you refer someone to the Service, including their first and last name, email address and phone number. We will use the information you provide to fulfill your referral requests, including (if applicable) sending them a text message to use the Service. We may use their contact information for a referral program but won’t send other marketing communications to them unless they have a separate relationship with us. Such functionality is intended only for U.S. residents. By using this functionality, you acknowledge and agree that both you and your contacts are based in the U.S. and that you have your contacts’ consent for us to use their contact information.
You may choose to voluntarily submit other information to us through the Service that we do not request, and, in such instances, you are solely responsible for such information. When you submit information we do not request, such as when you use the Notes functionality on the Service or communicate with us via email, chat or message forms, we ask that you not share sensitive information or information that violates our Terms of Service (e.g., discriminatory or illegal). If you use the chat function, we may use chatbots to communicate and record your chat communications for training and customer service purposes (whether you are chatting with a chatbot or a person). You consent to use of such chatbots and recording. In addition, we may collect and share the content of your chat with our third-party vendors.
Information We Automatically Collect. We also automatically collect information resulting from your use of the Service, including your preferences and other tendencies. This may include aggregated or de-identified “traffic data” or tracking information provided by the Site’s host or similar provider of such information (i.e., analytics) that does not personally identify you but may be helpful for marketing purposes or for improving the Service. Analytics is the process of collecting, analyzing and reporting aggregated data. Other information we may also automatically collect includes which pages visitors visit, how long visitors stay on a particular page, emails and advertisements you view, which Service visitors view, visitors’ referring and existing pages and where visitors are located using imprecise location data (such as location derived from an IP address or data that indicates location on a city or postal code level) and precise location data (such as latitude/longitude). This helps us tailor the Service to you, such as by helping you find nearby agents. It may also provide information about what browser, network or device is used to visit our Site. If you use the Service to search for rental properties or submit a rental application through the Service, we may automatically collect information from or about you, to the extent permitted by this Privacy Policy and our Terms of Service.
In addition, when you visit our Site, we may also log your IP address, a unique identifier for your computer or other access device, as well as your browser type, device type, device operating system, Internet service provider, your device’s regional and language settings and device identifiers. This helps us diagnose problems with our servers, to administer our Site, to provide our Service and to display the content according to your preferences.
Information From Other Sources. We also collect information from other sources. The categories of sources from which we collect information include:
- Data brokers from whom we purchase data to supplement the data we collect,
- Social networks with which you interact,
- Partners that offer co-branded services or products,
- Publicly available sources including websites and data in the public domain,
- Commercially available sources including other websites and services,
- Credit reporting agencies,
- Banks and credit unions,
- Collections agencies, and
- Property management companies, agents, landlords, tenant management service companies, sub-lessors and other real estate professionals.
Information from our Clients. As we provide our Service to our clients (e.g., property management companies, landlords, agents and other property professionals), we collect and process information about individuals (including through tracking technologies and other automated means) (“Client Data”). Client Data has historically included contact data, demographic data, content, employment and education history, and location data, among other information we collect when we provide our Service. Our clients, including agents, may upload files to our platform that include this information and that information may be used as described in this Privacy Policy.
Our processing of Client Data is governed by the terms of our agreements with our clients, and not this Privacy Policy. In the event we are permitted to process Client Data for our own purposes, we will process the Client Data in accordance with the practices described in this Privacy Policy. We are not responsible for how our clients treat the information we collect on their behalf, and we recommend you review their privacy policies. For further information on your rights and choices regarding Client Data, see the “Your Rights and Choices Regarding Your Information” section below.
Third-Party Privacy Policies. Through the Service, you may be able to link to or otherwise utilize technology, software and services owned and controlled by third-parties (“Third-Party Services”). You may be permitted or required to submit personal information to access Third-Party Services. For example, we may allow you to sync your calendar with the Service to automatically update it with new meetings. Such use of Third-Party Services and submission of information through Third-Party Services will be subject to such applicable third-party’s terms of use, terms of service, privacy policy and/or practices. You agree to look solely to the applicable third-party and not to RentSpree to enforce your rights in relation thereto. When you have clicked on a third-party logo or URL displayed or accessible through the Service which links you to any Third-Party Services, our Privacy Policy and Terms of Service no longer apply, and you must read the terms of use, terms of service, and privacy policy of the third-party or contact the third-party directly to determine how your personal information will be handled by them.
How We Use Your Information. We use the information we collect for business and commercial purposes in accordance with the practices described in this Privacy Policy. The personal information you provide to us allows us to communicate with you and provide you the Service, depending on the aspects of the Service you utilize. We primarily use the personal information you provide and any general information we receive from you for the following business and commercial purposes:
- To provide the Service,
- To create and manage your account,
- To process your orders, requests or applications submitted through the Service;
- For billing purposes,
- To facilitate communications between you and other users on the Service (e.g., to allow you to communicate with a property management company, agent, other real estate professional, sub-lessor or landlord of the property you would like to rent and vice versa),
- To authorize access to your consumer or background reports,
- To verify your identity,
- To send you technical notices, updates, security alerts, information regarding changes to our policies and support and administrative messages,
- To prevent and address fraud and threats of harm,
- To personalize your customer experience, including to help prepare your rental application or calculate your renter score and determine the probability you will be accepted or denied if you submit a rental application,
- To provide customer service, whether it’s responding to a request or following up on an order,
- To monitor, analyze trends, usage and activities,
- To process job applications and for employment purposes if you apply for a job through the Site,
- To train our artificial intelligence models that we use for predictive modeling as described in that section in this Privacy Policy,
- To develop profiles of potential homebuyers and renters based on our predictive modeling,
- To improve our Service, the interactions you have with our Service, and other RentSpree websites, apps, marketing efforts, products and services,
- To market products and services that may be of interest to you. For instance, we may add you to our email list and newsletter, auto-create email marketing campaigns on behalf of our clients, suggest listings to you, or suggest next steps based on your use of the Service,
- To provide property management companies, agents, landlords, other property professionals and other users of our Service with the ability to offer you other products and services that may be of interest to you,
- To comply with and enforce applicable legal requirements, relevant industry standards and our policies,
- To send reminders to your landlord about your move-in/move-out dates and birthdate,
- To fulfill any other purpose at your direction,
- To calculate your individual renter score, and
- With notice to you and your consent.
We keep track of your interactions with us, including but not limited to your activity within the Service. Except as set forth in this Privacy Policy, or unless we have your consent, we won’t share your personal information with any person or entity other than those affiliated with us, entities acting on our behalf and our service providers (such as those needed to collect and maintain our servers and perform technology-related services).
We may use information that we’ve collected in a manner such that the end-product does not personally identify you or any other user of the Service (including information that has been de-identified or aggregated). We aggregate or de-identify information by either combining it with information about other users (aggregating your information with information about other users), or by removing characteristics (such as your name or email address) that make the information personally identifiable. We may use aggregated or de-identified information for any purpose except as prohibited by applicable law.
Do Not Track. RentSpree does not honor the request of “do not track” signals sent by your browser when you visit the Site or use our app. For more information on “Do Not Track,” visit www.allaboutdnt.com.
Analytics. We use third-party providers to help us learn about who visits the Site, how the Service is used, and what pages are being viewed. For more information about these services, please use the links below:
Cookies. “Cookies” are small bits of information that a website sends to a visitor’s browser and are stored on the visitor’s hard drive. Like many websites, we employ cookies in certain areas of the Site to allow us to provide information to make your online experience more convenient. For example, cookies provide information to the Site when you return to it after logging in so that the Site will remember who you are on subsequent visits; cookies also speed up or enhance your experience of the Service by, for instance, tailoring content to you. Cookies may also be used to keep track of your login name and password. You may still access the Service if you set your browser not to accept cookies.
Third-parties whose websites are accessible through links on the Site may also use their own cookies when you link to their site or services. RentSpree does not control these third-parties’ use of cookies and cannot guarantee that they will uphold the same privacy standards as RentSpree. RentSpree expressly disclaims any and all liability related to the collection, use or disclosure of information by third-parties. You should review the privacy policies of any third-party websites that you visit through a link from the Site to understand how these third-parties use cookies and the information they collect through cookies. Most cookies are “session cookies” which means that they are automatically deleted at the end of each session. We also use persistent cookies which may remain on your device for extended periods of time. Persistent cookies help with personalizing your experience and supporting security features. Additionally, persistent cookies allow us to bring you advertising on and off the Service. Most browsers are initially set to accept cookies. You may be able to set your browser to notify you when you receive a cookie, giving you a chance to decide whether or not to accept it.
Log Information. Our servers automatically record information that your browser sends whenever you visit the Site. This information includes your IP address; your browser type and version; the search engine you used to find the Service, if any; which aspects of the Service you use and from where; and when and how long you use them. We use this information to monitor and analyze how users use the Service, to provide customer service and to maintain and improve the Service. We may also collect similar information from emails we may send to you which then help us track which emails are opened and which links are clicked by recipients. The information allows for more accurate reporting and improvement of the Service.
Pixels (Also Known as Web Beacons). Pixels are code embedded in a website, email or ads that sends information about your use of our Service, including the pages visited, how long you remain on a page, and the images or ads clicked, to a server. There are various types of pixels, including image pixels (which are small graphic images) and JavaScript pixels (which contains JavaScript code). When you access a website, email or ad that contains a pixel, the pixel may permit us or a separate entity to drop or read cookies on your browser and collect the usage information and your interaction with our Service. Pixels are used in combination with cookies to track activity by a particular browser on a particular device. We may incorporate pixels from separate entities that allow us to track usage and bring you ads on and off the Service. By using the Service, you consent to the collection of data and the tracking of your interactions with our Service by such pixels.
Heat Mapping. We use tracking technology that can create heat maps to visualize user behavior (for example, highlighting what parts of our Site you viewed and did not view).
Use of Analytical Data and Predictive Modeling. We use algorithms and artificial intelligence models (“AI Models”) for predictive modeling purposes, specifically to determine the likelihood of a renter buying a home in a certain period of time. The AI Models use your personal information from your rental and public records data relating to property and ownership to train the AI Models and develop a home buyer predictive score (“RentSpree Home Buyer Predictive Score”) and a separate Rent-Spree calculated renter score. You should not rely on the factual accuracy of output from AI Models or the RentSpree Home Buyer Predictive Score or RentSpree-calculated renter score. We may share this RentSpree Home Buyer Predictive Score and RentSpree-calculated renter score with real estate agents and property owners that register for our Service, provided if we do, we will provide you the right to opt-out of the creation and sharing of the RentSpree Home Buyer Predictive Score and RentSpree-calculated renter score, to the extent required by law.
You further agree and acknowledge that we may collect, use and store your personal information in connection with providing you access to the Platform and Services and the creation and development of analytical and statistical analysis tools relating to the use of the data we collect in providing the Service (the “Analytical Data”). You expressly authorize and consent to us making any commercial use of the Analytical Data, including without limitation, selling and sharing Analytical Data with third-parties, as further described in this Privacy Policy and to the extent permitted by applicable law. You can opt-out of any sharing or sale of your personal information to the extent included in Analytical Data by utilizing our opt-out link on our home page or emailing us at [email protected].
Location-identifying Technologies. Location-identifying technologies, which include GPS (global positioning systems) software, geo-filtering, Bluetooth, beacons, and other location-aware technologies, are used to locate you (as described in more detail in the “Geolocation Data” section below) for purposes such as verifying your location and delivering or restricting relevant content based on your location. You may limit access to your location data by adjusting the permissions in your device. If you grant us permission, we may collect location information when the Site or our app is running in the foreground or background.
In-App Tracking Methods. In-app tracking methods, which include a variety of tracking technologies, are used in mobile apps. These tracking technologies are not browser-based like cookies and cannot be controlled by browser settings. Some use device identifiers or other identifiers such as mobile ad IDs to associate app user activity to a particular app and to track user activity across apps. Our apps may also include Software Development Kits or “SDKs,” which is code that sends information about your use to a server. These SDKs allow us to track and bring you advertising both on and off the Service including on your social media accounts.
Children’s Privacy. We do not knowingly collect personal information from children under 13 or allow them to create an account for the Service. The Service is designed for a general audience and you must be 18 years old to use the Service. We take children’s privacy seriously and encourage parents to play an active role in their children’s online experience at all times.
Targeted Advertising. We use advertising tools to help us improve your advertising experience (such as by serving advertisements on our behalf across the Internet, serving personalized ads on our Site and providing analytics services). For example, the remarketing, re-engagement or similar audiences feature in Google Ads allows us to reach people who previously visited our Site or used our app and match the right people with the right content.
We also use audience matching services (which is a type of targeted advertising) to reach people who’ve visited our Site or are identified in one or more of our databases. This is done by providing a list of hashed email addresses to an ad partner or incorporating a pixel from an ad partner into our own Site, and the ad partner matching common factors between our data and their data. For instance, we may incorporate the Facebook pixel on our Site and may share your email address with Facebook as part of our use of Facebook Custom Audiences.
The companies we work with to provide you with targeted ads are required to give you the choice to opt out of receiving targeted ads. Most of these companies are participants of the Digital Advertising Alliance (“DAA”) and/or the Network Advertising Initiative (“NAI”). Google provides tools to allow you to opt out of the use of certain information collected by Google Analytics here and by Google Analytics for Display Advertising or the Google Display Network here.
You may have the right to opt-out of targeted advertising if you are a resident of California, Connecticut, Colorado, Utah and Virginia. Please see the state specific sections below for how to opt-out of such advertising. This list is not exhaustive, and residents of states not included above may have additional opt-out rights.

2. How We Share Your Information
Sharing Your Information. We use your information to provide you the Service; complete transactions; handle your customer service questions or issues; and send you communications about notifications, promotions updates or special offers from RentSpree that may be of interest to you. The personal information uploaded by you through the Service, or collected about you through the Service, or information developed about you (such as the RentSpree Home Buyer Predictive Score or RentSpree-calculated renter score described above) will be shared only as set out in this Privacy Policy and with authorized persons, including landlords, landlord representatives, brokers, property managers, other real estate professionals and sub-lessors, and when necessary RentSpree employees. As also indicated in this Privacy Policy, we also share information with such third-parties to facilitate their ability to offer you other products and services that may be of interest to you. We will also share the information we collect from you under the following circumstances, and you expressly authorize us to share your information as follows:
Provision of RentSpree Service
Prospective Tenants. For prospective tenants, RentSpree uses the personal information you provide, and information collected about you through background and credit checks to fulfill the Service you request from us. This may include sharing your personal information with any of our vendors or partners; with our affiliates (including our subsidiaries); or with any landlord, landlord representative, broker, property manager, other real estate professionals or sub-lessors with whom you may wish to engage in a rental transaction or activity. The information we share with landlords, landlord representatives, brokers, property managers, other real estate professionals and sub-lessors may include your RentSpree-calculated renter score and RentSpree Home Buyer Predictive Score. Except as described in this Privacy Policy, RentSpree will not disclose or share your personal information with any third-party.
NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THIS PRIVACY POLICY, RENTSPREE WILL NOT BE LIABLE TO YOU OR ANY OTHER PARTY FOR ANY USE OR MISUSE OF YOUR PERSONAL INFORMATION BY ANY THIRD- PARTY WITH WHOM YOUR PERSONAL INFORMATION HAS BEEN SHARED IN ACCORDANCE WITH THE TERMS OF THIS PRIVACY POLICY.
Landlords and Property Owners and Their Representatives, Brokers, Property Managers and other Third-Parties to Offer and Provide You Other Products and Services. RentSpree also shares your information, including personal information, RentSpree Home Buyer Predictive Score and RentSpree-calculated renter score with landlords, landlord representatives, property owners, brokers, agents, property managers and other third-parties so they may offer and provide you other products and services that may be of interest to you.
Protection of Rights. We will share personal information if we have a good faith belief that (i) access, use, preservation or disclosure of such information is reasonably necessary to satisfy any applicable law, regulation, legal process, such as a court order or subpoena, or a request by law enforcement or governmental authorities, (ii) such action is appropriate to enforce our Terms of Service, including any investigation of potential violations thereof, (iii) such action is necessary to detect, prevent, or otherwise address fraud, security or technical issues associated with the Service, or (iv) such action is appropriate to protect the rights, property or safety of RentSpree, its employees, users of the Service or others.
Service Providers. We may share your information with service providers who assist us in the provision of our Service. For example, we may share your information with TransUnion (or another credit reporting agency), which may gather, compile and share a credit report and score with relevant landlords, landlord representatives, brokers, property managers, other real estate professionals and sub-lessors. Or we may share your information in order to enable a third-party to conduct a criminal background check or eviction search. We may share your personal information with service providers (including our affiliates that provide services on our behalf) that we engage for the purpose of processing information on our and your behalf (e.g., payment processors).
Vendors and Other Parties. We may partner with other companies for advertising purposes and to process, analyze and/or store data, including, but not limited to, information collected automatically. While providing services for us, these companies may access your personal information. To the extent applicable, we require these entities to comply with appropriate confidentiality and security measures.
Affiliates. We share information with our affiliates and related entities, including where they act as our service providers or for their own purposes.
Asset Transfers. If we become involved in a merger, acquisition or other transaction involving the sale of some or all of RentSpree’s assets or equity, user information, including personal information collected from you through your use of the Service, could be included in the sale. Should such an event occur, we will use reasonable means to notify you through email and/or a prominent notice on the Site.
Partners. We share information with our partners in connection with offering co-branded services, selling or distributing our services, or engaging in joint marketing activities.
Facilitating Requests. We share information at your request or direction.
Consent. We share information with notice to you and your consent.
Notwithstanding the above, we may share information that does not identify you (including information that has been aggregated or de-identified) except as prohibited by applicable law. For information on your rights and choices regarding how we share information about you, please see the “Your Rights and Choices Regarding Your Information” section below.
Additional Information You Should Know About Third-Parties. The Service may contain direct links to websites operated by our partners and other entities. These third-party websites may collect information about you when you visit them or otherwise communicate with them. This Privacy Policy does not cover the information practices of third-party websites linked to the Site or accessible through the Service. Although we encourage such third-parties to adopt and follow their own privacy policies, we are not responsible for their collection and use of your personal information.
We may also offer our content through social media sites. Any information you provide to us when you engage with our content (such as via our branded page on Facebook) is treated in accordance with this Privacy Policy. Also, if you publicly reference us or our Site on social media (e.g., by using a hashtag associated with RentSpree in a tweet or post), we may use your reference on or in connection with our Site.
You should refer to the privacy policies and statements of other websites or contact the respective webmasters of those websites to obtain information regarding their information collection, use and disclosure policies.
Your Rights and Choices Regarding Your Information
Control of Your Information. After creating an account through the Service, you may update or delete your personal information or modify your account preferences for the Service by accessing the user dashboard provided through the Service. Please note that if you disable your account, we will keep your contact information on file, and may retain other account information for a reasonable period of time afterward for various purposes including internal account management and fraud prevention.
Your Choice to Opt-Out. If you no longer want to receive our newsletters, emails or other marketing communications, you may unsubscribe by following the “unsubscribe” link at the bottom of our emails or by writing to us at [email protected].
If you no longer want to receive text message communications and calls to your phone number, you may opt-out at any time by (i) for texts, texting “STOP” to the appropriate short code available in each text message or contacting us at [email protected] and specifying you want to opt-out of text messages; and (ii) for calls, requesting to opt-out during any call you receive from us or contacting us at [email protected] and specifying you want to opt-out of calls. If you no longer want to receive push notifications or in-Service messages, you may adjust the permissions in your account, delete your account or uninstall our app.
Please note that you cannot unsubscribe from certain correspondence from us, including messages relating directly to your account, your rental screening submission, or other rental-related processes. Your opt-out is limited to the email address, phone number or device used and will not affect subsequent subscriptions. Please note that any information collected for background screening is exempt from the opt-out provisions of this Privacy Policy.
How We Store and Safeguard Your Information. We care about protecting your information, so we employ physical, technical and administrative safeguards designed to help keep it safe, including encryption and techniques to reduce the ability to identify an individual in some cases. Since no data transmission over the Internet or other network can be guaranteed to be 100% secure, we cannot and do not guarantee the security of any information you transmit on or through our Service. Additionally, when you communicate with customer service via email, chat or message forms, we ask that you not share sensitive information. While we strive to protect user information, we cannot ensure or warrant the security of any information you transmit to us or through the use of the Service and you acknowledge and agree that you provide such information and engage in such transmissions at your own risk. Once we receive a transmission from you, we will endeavor to maintain its security on our systems.
In the event that personal information you provide to us is compromised as a result of a breach of security, when appropriate we will take reasonable steps to investigate the situation, notify you and take the necessary steps to comply with any applicable laws and regulations.
When you register on our Site, you will need to set up a password to access your information. If you want to change your password, log into the RentSpree Dashboard, select “My Profile”, then select “Change Password” and follow the instructions found on the screen. Note that we don’t ask customers to confirm account or credit card details by email – if you receive an email claiming to be from us and asking for this information, do not respond.
International Transfers. We are headquartered in the U.S. and the information we collect is governed by U.S. law. If you are accessing the Service from outside of the U.S., please be aware that information collected through the Service may be transferred to, processed, stored, and used in the U.S. and other jurisdictions. Data protection laws in the U.S. and other jurisdictions may be different from and less protective than those of the country from which you are accessing the Service. Privacy Rights of Residents of Connecticut, Colorado, Virginia and Utah. If you are a resident of Connecticut, Colorado, Virginia or Utah, you may have additional rights relating to your personal information: Virginia, Colorado, Connecticut and Utah. Depending on the state, you may have the right to request the following:
1. To confirm whether or not we’re processing your personal information and to access such personal information;
2. To correct inaccuracies in your personal information, taking into account the nature of the personal data and the purposes of the processing of the personal data;
3. To delete your personal information;
4. To obtain a copy of your personal information you provided us in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another controller without hindrance, where the processing is carried out by automated means;
5. To opt out of the processing of your personal information for purposes of targeted advertising, the sale of personal data and except in Connecticut certain profiling (and to the extent the applicable law requires us to honor opt-out preference signals, such as a Universal Opt-out Mechanism under Colorado law, we will do so);
5. For residents of Connecticut, Colorado and Virginia, to opt out of profiling in furtherance of decisions (or in Connecticut solely automated decisions) that produce legal or similarly significant effects concerning the consumer; and
6. To not be discriminated against for exercising your privacy rights under these laws.
This list is not exhaustive, and residents of states not included above may have additional rights relating to privacy and their personal information.

For each of these states, we may require additional information to verify your identity before responding to the request. Nevada Residents Privacy Rights. Nevada law (NRS 603A.340) requires each business to establish a designated request address where Nevada consumers may submit requests directing the business not to sell certain kinds of personal information that the business has collected or will collect about the consumer. A sale under Nevada law is the exchange of personal information for monetary consideration by the business to a third-party for the third-party to license or sell the personal information to other third-parties. California Residents Privacy Rights/California Consumer Privacy Act. The California Consumer Privacy Act of 2018 (the “CCPA”) is a California law that gives California residents (“consumers”), the right to learn about and control certain aspects of how a business handles the personal information that it collects about them. Pursuant to the CCPA, consumers have certain rights, including:
1. The right to know what personal information a business has collected about a consumer, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling or sharing personal information, the categories of third-parties to whom the business discloses personal information and the specific pieces of personal information the business has collected about a consumer;
2. The right to delete personal information a business has collected from a consumer, subject to certain exceptions;
3. The right to correct inaccurate personal information that a business maintains about a consumer;

6. Geolocation Data
We use Google Analytics (and may use other providers) which tracks users down to the city level. We also use Amplitude (and may use other providers) which tracks the IP addresses of users which can imply the approximate, but not the precise, location of users. In doing so, we track imprecise location data (such as location derived from an IP address or data that indicates location on a city or postal code level) and precise location data (such as latitude/longitude).
Purpose: We collect this information to provide, develop and improve the Service, respond to your questions or requests, troubleshoot, prevent fraud and market to you.

7. Biometric information. We don’t collect this information.
8. Audio, Electronic, Visual, Thermal, Olfactory or Similar information
We may record calls and chats when you contact customer service or use our chat function (whether with a chatbot or a person). We may collect and share the content of your chat with our third-party vendors.
Purpose: We collect this information when you call us or contact us via chat to improve our Service, respond to our inquiries and resolve customer service issues. In addition, we may collect and share this information with our third-party vendors for the development of our Service.

9. Professional or Employment-Related Information
Purpose: We collect this information to provide the Service, respond to your questions or requests, troubleshoot and prevent fraud. We may also collect this information from job applicants applying for a position with us through our Site.
Sources: We collect this information from information you provide and information from third-party recruiters, job referral sites or executive search firms.
10. Education information as Defined in the Family Educational Rights and Privacy Act (20 U.S.C. Sec. 1232g). We generally don’t collect this information. We do collect education information only that you may provide in connection with your job application.
11. Inferences drawn from the above about your predicted characteristics and preferences. We create inferences based on the personal information described above to provide, develop and improve the Service and market to you and to develop the RentSpree Home Buyer Predictive Score and RentSpree-calculated renter score. Please note that the RentSpree Home Buyer Predictive Score, RentSpree-calculated renter score and other developed information may not be factually accurate, and you should not rely on the factual accuracy of such output from our AI Models. In addition, the Analytical Data that we may develop as set forth above may involve developing inferences based on your personal information and use of our Service.
12. Sensitive Personal Information. We collect the following sensitive personal information: Social Security number, date of birth, driver’s license, passport, identification card and other government-issued ID.
Purpose: We collect this information to provide the Service, prevent fraud and ensure creditworthiness and eligibility for renting properties.

Please note that information obtained from a consumer reporting agency under the Fair Credit Reporting Act is exempt from the requirements of the CCPA. Please review the “How We Share Your Information” section above for further details about the categories of parties with whom we share information.
Retention of Personal Information. We generally retain your personal information in the categories listed above for as long as necessary to fulfill the purpose of the collection and for any period required to comply with legal obligations. More specifically, we generally maintain your personal information for as long as you maintain an account with us or use the Service. If you cancel your account or stop using the Service we may continue to retain your personal information for compliance purposes or as required by property owners, property managers, leasing agents and other property professionals for their compliance and business purposes.
Sharing, Sale and Disclosure of Personal Information to Third-Parties. During the past 12 months, we have shared the following categories of personal information with social media platforms and digital advertising providers for the purpose of sending you targeted or cross-context behavioral advertising about our Service and rental properties based on your preferences and interests: names and email addresses.
During the past 12 months, we have also disclosed your personal information to property owners, property managers, leasing agents, other property professionals and sub-lessors for the purpose of their assessing your interest in properties and determining your creditworthiness and eligibility for renting those properties, and processing your rental applications including identifiers, personal information described in subdivision (e) of Section 1798.80, professional or employment-related information and credit reports.
Your Rights Under the CCPA
Notice of Right to Opt-Out of Sale or Sharing of Your Personal Information
Consumers have the right to request that a business that sells or shares the consumer’s personal information, or that discloses it for a business purpose, inform the consumer of what has been collected about them and who it has been sold, shared or disclosed to, and the business or commercial purpose for the sale, sharing and disclosure. Sharing under the CCPA means the sharing of personal information with a third-party for cross-context behavioral advertising.
Consumers also have the right, at any time, to direct a business that sells personal information about them not to sell their personal information.
RentSpree doesn’t currently sell your personal information in exchange for payment; we do disclose your personal information to property owners, property managers, leasing agents and other property professionals at your direction, but we believe this does not constitute a sale under the CCPA since by using the Service you intend to interact with such parties. We may in the future for compensation sell predictive scores (such as the RentSpree Home Buyer Predictive Score), RentSpree-calculated renter score or Analytical Data or refer prospective renters to third-party sites where the prospective renter has the ability to engage with that site; such transactions may be considered a sale for which the opt-out would apply.
We also endeavor to forbid our service providers from selling the personal information they receive from us or on our behalf, and require them to only use that information to perform the services we have asked of them, unless otherwise required by law.
We also may share your personal information for cross-context behavioral advertising or targeted advertising with social media platforms and digital advertising platforms. We also use advertising tools to help us improve your advertising experience (such as serving advertisements on our behalf across the Internet, serving personalized ads on our Site, and providing analytics services). Sharing personal information with these third-parties while using these tools may fall within the extremely broad definition of the “sale” of personal information under the CCPA and may also constitute “sharing” for cross-context behavioral advertising. For example, Google may use this data to improve its ad services for all companies who use their services. This practice is very common.
For these reasons, we offer an opt-out from the sale and sharing of your personal information under the CCPA. You may opt out of the sale or sharing of your personal information at any time by clicking Do Not Sell or Share My Personal Information on our homepage or emailing us at [email protected]. We will also honor opt-out preference signals that comply with requirements of the CCPA. We have no knowledge that we sell or share the personal information of consumers under 16 years of age. Please note that any information collected for background screening is exempt from the opt-out provisions of this Privacy Policy.
Right to Know
Consumers also have the right to request that a business that collects personal information about them disclose the following: (1) the categories of personal information, (2) the categories of sources from which the personal information is collected, (3) the business or commercial purpose for collecting, selling or sharing personal information, (4) the categories of third-parties to whom the business discloses personal information, and (5) the specific pieces of personal information the business has collected about the consumer. This is referred to as a right to know.

2) If you submit your response via email, we will reach out within 10 business days to confirm that we have received your request.
3) We will then take steps to determine whether your request is a valid Verifiable Consumer Request. If you have an account, we may ask you to login to confirm this information. We will not ask you to create an account if you do not already have one. We will only ask for information that is reasonable in light of the nature of your request.
4) When you submit a Right to Know request: a) Within 45 days of receipt of the request, we will provide you with a copy of the information listed in “Right to Know,” above, by mail or electronically through a secure means, except to the extent we have a right to deny the request due to disproportionate efforts or another basis set forth in the CCPA and its implementing regulations. To the extent possible, this information will be provided in a portable and usable format, b) If we need additional time, we will inform you within the initial 45-day period of our need for an additional 45 days (for a maximum of 90 days between receipt of the request and provision of information), and c) We are not required to respond to a right to know request by a consumer more than twice in a 12-month period.
Right to Correct. Consumers have the right to request that a business correct inaccurate personal information that a business maintains about the consumer.

2) If you submit your response via email, we will reach out within 10 business days to confirm that we have received your request.
3) We will then take steps to determine whether your request is a valid Verifiable Consumer Request. If you have an account, we may ask you to login to confirm this information. We will not ask you to create an account if you do not already have one. We will only ask for information that is reasonable in light of the nature of your request.
4) We may require you to submit documentation to support the request to correct if necessary to rebut our own documentation that the personal information is accurate.
5) When you submit a request to correct: a) Within 45 days, we will either correct or delete the inaccurate information or deny the request and provide the basis for the same, including if we determine that the contested personal information is more likely than not accurate based on the totality of the circumstances, and b) If we need additional time, we will inform you within the initial 45-day period of our need for an additional 45 days (for a maximum of 90 days between request and provision of information).
Right to Deletion. Consumers have the right to request that a business delete any personal information about them. However, there are exceptions to this rule. For example, a business does not have to delete information if it is necessary to: a) complete a transaction; b) prevent illegal activity; c) exercise free speech; d) comply with a legal obligation; e) identify or repair errors that impair functionality; or f) enable solely internal uses that are reasonably aligned with the expectations of the consumer based on the consumer’s relationship with the business and compatible with the context in which the consumer provided the information.

We will not ask you to create an account if you do not already have one. We will only ask for information that is reasonable in light of the nature of your request.
4) When you submit a request for deletion: If you have an account, we may ask you to login to confirm this information. For consumers that do not have an account, we have created a two-step process for responding to requests for deletion. After you submit the initial request, we will ask that you separately confirm that you would like your information deleted. If your request does not fall within one of the exceptions to deletion listed in “Right to Deletion,” above, we will confirm deletion within 45 days. If we are not required to delete your account, we will also let you know within 45 days.
Right To Limit Use and Disclosure of Sensitive Personal Information. If a business uses or discloses sensitive personal information for reasons other than those set forth below, it must provide consumers the right to limit the use or disclosure of sensitive personal information by the business:
1) To perform the services or provide the goods reasonably expected by an average consumer who requests those goods or services.
2) To detect security incidents that compromise the availability, authenticity, integrity and confidentiality of stored or transmitted personal information, provided that the use of the consumer’s personal information is reasonably necessary and proportionate for this purpose.
3) To resist malicious, deceptive, fraudulent or illegal actions directed at the business and to prosecute those responsible for those actions, provided that the use of the consumer’s personal information is reasonably necessary and proportionate for this purpose.
4) To ensure the physical safety of natural persons, provided that the use of the consumer’s personal information is reasonably necessary and proportionate for this purpose.
5) For short-term, transient use, including, but not limited to, non-personalized advertising shown as part of a consumer’s current interaction with the business, provided that the personal information isn't disclosed to another third-party and isn't used to build a profile about the consumer or otherwise alter the consumer’s experience outside the current interaction with the business.
6) To perform services on behalf of the business, such as maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing analytic services, providing storage or providing similar services on behalf of the business.
7) To verify or maintain the quality or safety of a service or device that is owned, manufactured, manufactured for, or controlled by the business, and to improve, upgrade, or enhance the service or device that is owned, manufactured by, manufactured for, or controlled by the business.
We do not use or disclose your sensitive personal information for any purpose other than those specified above and do not use your sensitive personal information (excluding exempted creditworthiness information subject to the FCRA and exempt from the CCPA) to infer characteristics about you. Accordingly, we are not required to offer consumers the ability to request to limit use or disclosure of their sensitive personal information.
Right to Non-Discrimination. A business cannot discriminate against a consumer because the consumer exercised any of the consumer rights listed above.
Authorized Agent. As a California resident, you have the right to designate an agent to exercise these rights on your behalf. We may verify your identity directly with us and request that you confirm to us that you provided the authorized agent permission to submit the request, unless you have provided the authorized agent with a power of attorney pursuant to Probate Code sections 4121-4130. Client Provided Data. We acknowledge that you may have rights under the CCPA in connection with the personal information we process (to the extent that we process such information) on behalf of our clients. If personal information about you has been processed by us as a service provider on behalf of a client and you wish to exercise any rights you have with such personal information, please inquire with our client directly. If you wish to make your request directly to us, please provide the name of our client on whose behalf we processed your personal information. We will refer your request to that client and will support them to the extent required by applicable law in responding to your request, unless we are required by law to respond directly to the request.

Laws, regulations and industry standards evolve, which may make those changes necessary, or we may make changes to our services or business.
